INTERNATIONAL COURIER & CARGO – TERMS & CONDITIONS

By booking or handing over a shipment to Cloud Line Cargo & Logistics (P) Ltd. (“Cloud Line”), the customer confirms that they have read, understood and accepted the following Terms & Conditions.

1. Customer Responsibility

The customer is responsible for providing accurate sender and receiver details, item descriptions, quantities, values, contact numbers and other required information. Any loss, delay, penalty, additional charge or customs issue arising from incorrect, incomplete or misleading information provided by the customer shall be the customer’s responsibility.

2. Packing & Fragile Items

Customers must ensure that all items are properly packed and suitable for international transportation.

Fragile, breakable, leakage-prone, liquid, glass, ceramic, food and other damage-prone items are accepted at the customer’s risk, subject to applicable laws and carrier restrictions.

Cloud Line shall not be responsible for damage, breakage or leakage caused by the inherent nature of the item, inadequate or improper customer packaging, internal movement of contents, normal transportation/handling, or circumstances beyond Cloud Line’s reasonable control.

Where packing is carried out by Cloud Line, the packing service is intended to provide reasonable protection but does not constitute a guarantee against damage, leakage or breakage.

3. Prohibited & Restricted Items

The customer must not include prohibited or restricted items in any shipment.

This may include, but is not limited to, dangerous goods, explosives, flammable items, aerosols, perfumes/sprays where restricted, batteries or battery-containing items where prohibited, magnetic items, currency, precious metals, weapons, sharp objects and other items restricted by airlines, customs authorities, destination countries or transportation partners.

If prohibited or undeclared goods are found, Cloud Line may refuse, hold, return, dispose of or otherwise deal with the shipment as permitted by applicable law and carrier regulations. Any resulting charges, penalties, return costs or losses may be charged to the customer.

4. Customs & Declaration

The customer is solely responsible for providing a truthful and complete declaration of the contents and value of the shipment.

Customs authorities in India or the destination country may inspect, hold, confiscate, return or assess the shipment.

Any customs duty, tax, clearance charge, inspection charge, penalty or other government/authority charge arising from the shipment or its contents shall be payable by the customer where applicable.

5. Delivery Time

Any delivery period quoted by Cloud Line is an estimated transit time only.

Transit days shall be counted from the date the shipment is dispatched from our warehouse for international movement.

Cloud Line shall not be responsible for delays caused by customs clearance, security checks, airline schedules, weather, strikes, operational disruptions, destination restrictions, government actions, incorrect receiver details, non-availability of the receiver or other circumstances beyond Cloud Line’s reasonable control.

6. Inspection & Repacking

Cloud Line, its forwarding partners, airlines, customs authorities or other authorised parties may inspect shipments where required for security, customs, operational or regulatory purposes.

Where necessary, a shipment may be opened, repacked, resealed, held or returned in accordance with applicable procedures.

7. Loss, Damage & Claims

Any claim relating to loss, shortage, damage or other shipment issues must be reported to Cloud Line within the applicable claim period communicated at the time of booking, together with supporting documents and evidence.

Claims may be subject to investigation and the applicable terms of the actual carrier, freight forwarder, airline, insurer or transportation partner handling the shipment.

Cloud Line shall not be liable for loss or damage resulting from prohibited/undeclared goods, inadequate customer packaging, incorrect declaration, inherent defects, normal wear or tear, leakage, breakage of fragile items, customs action, or circumstances beyond Cloud Line’s reasonable control.

8. Limitation of Liability

To the extent permitted by applicable law, Cloud Line’s liability for any loss, damage, delay or other claim arising from a shipment shall be limited to the liability, compensation or recovery available under the applicable service, carrier/forwarder terms, insurance coverage (if any), and applicable law.

Cloud Line shall not be liable for indirect, consequential or special losses, including loss of profit, business opportunity, emotional loss or other consequential damages, to the extent such exclusion is permitted by applicable law.

Nothing in these Terms & Conditions is intended to exclude or restrict any liability that cannot lawfully be excluded or restricted under applicable law.

9. No Guarantee for Fragile / Perishable / Damage-Prone Goods

Cloud Line does not guarantee that fragile, breakable, leakage-prone, perishable or otherwise damage-prone goods will arrive without damage, even where reasonable care has been taken during transportation.

Customers sending such goods acknowledge and accept the transportation risk.

10. Additional Charges

Any additional charges arising from remote-area delivery, customs clearance, inspection, storage, re-delivery, return, address correction, special handling, quarantine, destination charges or other unforeseen operational requirements may be payable by the customer where applicable.

11. Undeliverable Shipments

If a shipment cannot be delivered because of an incorrect address, unavailable receiver, refusal to accept the shipment, customs issue, prohibited contents or other reason attributable to the shipment/customer, the shipment may be returned, held or otherwise handled according to the applicable carrier and destination procedures.

Any resulting charges may be payable by the customer.

12. Force Majeure

Cloud Line shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, war, terrorism, strikes, epidemics, government restrictions, customs actions, airline disruptions, weather conditions, security incidents, transportation disruptions or other force majeure events.

13. Customer Acceptance

By booking, paying for, handing over or authorising transportation of a shipment, the customer confirms acceptance of these Terms & Conditions and acknowledges the risks associated with international transportation.

14. Applicable Law

These Terms & Conditions shall be interpreted subject to the applicable laws and regulations governing the relevant service and shipment.
